enlightened On May 9, 2025, Arbitrator Nguyen Manh Dung participated in a presentation at the conference "Skills Training for Commercial Arbitrators in Ho Chi Minh City in 2025," organized by the Ho Chi Minh City Commercial Arbitration Association and the Ho Chi Minh City Department of Justice.

enlightened During the conference, Arbitrator Nguyen Manh Dung, Director of ADR Vietnam Chambers, shared a presentation on "Experiences and Key Considerations in Arbitration Proceedings to Avoid Annulment of Awards." At the conference, Deputy Chief Judge of the Ho Chi Minh City People’s Court, Ms. Nguyen Thi Thuy Dung, mentioned that between January 1, 2011, and March 31, 2025, the Ho Chi Minh City People’s Court annulled 46 awards out of 268 requests, accounting for 18.3%. Meanwhile, the Vietnam International Arbitration Centre (VIAC) has handled 2,465 disputes, with only about 2% of awards being annulled from the total number of cases submitted to arbitration.


However, for Vietnam to become an international arbitration seat, arbitrators must be cautious in all stages of arbitration proceedings to prevent annulments. During his presentation, Arbitrator Nguyen Manh Dung highlighted risk factors that can lead to award annulment, accompanied by specific case examples.


- Pre-Arbitration Phase: Arbitration agreements (invalid or unenforceable agreements); Service of documents (especially Ex-parte proceedings); Establishing the arbitration tribunal (appointing arbitrators and the tribunal chair).


- During Arbitration Proceedings: Jurisdiction of the tribunal & Challenges to the tribunal's jurisdiction; Procedural issues (language of arbitration, applicable law, place of arbitration, procedural rules); Arbitration case management (CMC, PO1, Timetable); Collecting & assessing evidence (form and weight of evidence), witnesses, experts, etc.; Hearings; Award issuance timeline, drafting the award.


- Post-Arbitration Phase: Annulment requests (grounds for annulment, deadlines for requesting annulment).
