More than 12 years have passed since the enactment of the 2010 Law on Commercial Arbitration (LCA), and the commercial arbitration field in Vietnam has achieved significant milestones. There are currently over 44 domestic arbitration institutions in operation, along with some representative offices of international institutions. In 2022, the Vietnam International Arbitration Center (VIAC) successfully resolved 292 dispute cases, covering a wide range of areas, including the sale of goods, construction, finance, banking, and more. This impressive number significantly contributes to dispute resolution and alleviates pressure on the national court system. Recently, the Vietnam Lawyer Association proposed amendments to the 2010 Law on Commercial Arbitration aimed at addressing its limitations. Accordingly, the Vietnam International Arbitration Center (VIAC) is in the process of revising its Arbitration Rules.
To facilitate discussions and the exchange of opinions on the proposed amendments, as well as other issues that require changes to the LCA and the Arbitration Rules of VIAC and other arbitration institutions, and taking into consideration the provisions of the Model Law on International Commercial Arbitration and the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL), along with both domestic and international experiences, ADR Vietnam Chambers, in collaboration with Hop Dang's Chambers, is partnering with the Vietnam International Arbitration Center (VIAC), Vietnam International Law Firm (VILAF), YKVN, Hanoi Law University (to be confirmed), Ho Chi Minh City Law University, Foreign Trade University, and the Vietnam Business Lawyers Club (VBLC) to organize a series of talk shows on the "Discussion on the necessary amendments to the 2010 Commercial Arbitration Law and VIAC Arbitration Rules - Referencing Vietnam's practical experience, international expertise, and UNCITRAL Model Law/UNCITRAL Arbitration Rules." This series will focus on proposing and examining the necessary changes and their potential impacts on the arbitration market in Vietnam
