Alongside the mechanism for resolving disputes arising from multiple contracts, one of the major challenges in arbitration practice is when separate but closely related arbitration need to be decided together in a single arbitration. The consolidation mechanism is designed to address such situations efficiently in terms of both time and costs, while also reducing the risk of conflicting awards.

 

Topic 2: Consolidation in our series on Multi-party/Multi-contract Arbitration analyses and compares the consolidation provisions under VIAC – Vietnam’s leading arbitration center – with equivalent rules of renowned international institutions such as SIAC, HKIAC, and ICC, thereby highlighting the current legal gaps. Based on this analysis, the authors propose amendments and supplements to the consolidation mechanism under VIAC’s Arbitration Rules, as well as for arbitration institutions in Vietnam in general. This would better equip arbitrators and counsel to conduct proceedings under a legal framework more aligned with international standards.
