Topic 5: Conduct of arbitral proceedings
The conduct of arbitration proceedings plays a vital role in the dispute resolution and arbitration process in ensuring that a fair and efficient outcome is delivered to all parties. Currently, other than general provisions governing the language, place and applicable law to arbitration proceedings, the system of arbitration law in Vietnam lacks an adequate address the authority to govern the enforcement of arbitration proceedings and the authority to evaluate evidence, challenging the arbitral tribunal in reaching the ultimate goals of any arbitration proceeding. The fifth talk show contains an unstated discussion on "Arbitration Proceedings." The session will focus on the proposals in the amendments to the 2010 Arbitration Law by the Vietnam Bar Federation and compare them with the provisions of the UNCITRAL Model Law and Arbitration Rules on the topics of language in arbitration, the place of arbitration, applicable law, etc.
