Ad-hoc commercial mediation means a dispute resolution method by ad-hoc commercial mediators selected by the parties conducted in compliance with the provisions of the Governmental Decree no. 22/2017/ND-CP dated 24th February 2017 on commercial mediation and the parties’ agreements. Members of ADR Vietnam Chambers are duly registered, under this Decree, to operate as ad hoc mediators. Our Members are required to strictly comply with CEDR Code of Conduct for Third Party Neutrals. Parties are strongly recommended to adopt a standard mediation agreement in their contracts as follows:

For use before a dispute arises:

All disputes, controversies or differences arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be first referred to ad hoc mediation in Vietnam in accordance with the UNCITRAL Conciliation Rules as at present in force.

For use after a dispute has arisen:

All disputes, controversies or differences arising out of or in connection with this contract, including any question regarding its existence, validity or termination, may, notwithstanding the commencement of any other proceedings, be referred to ad hoc mediation in Vietnam in accordance with the UNCITRAL Conciliation Rules as at present in force.
