The rapid development of artificial intelligence (AI) presents both opportunities and challenges for the international arbitration community. Against this backdrop, the Chartered Institute of Arbitrators (CIArb) issued its “Guideline on the Use of AI in Arbitration” in 2025. The Guideline sets out key principles to assist parties, arbitrators, and arbitral institutions in adopting AI tools effectively, transparently, and fairly in the dispute resolution process.
⚖️ The Guideline focuses on three core principles: Transparency, Accountability, and Confidentiality – intended to ensure that the use of AI does not compromise the transparency or fairness of arbitral proceedings. It also addresses the limitations of AI tools and provides a framework for assessing the level of oversight required for different types of AI applications.
While AI and technology in general remain relatively unexplored areas in the context of arbitration in Vietnam, they are becoming increasingly relevant as the number and complexity of commercial disputes grow. A sound understanding of how to responsibly apply AI will be essential for Vietnam’s arbitration community to keep pace with international developments. Notably, the Vietnam International Arbitration Centre (VIAC) introduced the eCase online case management platform in its 2024 Annual Report. However, the application of AI in specific procedural stages still requires a suitable legal framework and thorough consideration to mitigate associated risks. CIArb’s Guideline serves as a valuable reference for shaping legal and ethical frameworks around AI in arbitration practice in Vietnam in the near future.
